Return of goods and withdrawal from the contract
1. A buyer who has concluded a sales contract outside his/her business activity as a consumer has the right to withdraw from the sales contract.
2. If the purchase agreement is concluded remotely (via an online store) or outside the seller's premises, and at the same time the seller has provided the buyer in a timely and appropriate manner with the right to withdraw from the purchase agreement, the conditions, period and procedure for exercising the right to withdraw from the purchase agreement, including the form for withdrawing from the purchase agreement (in accordance with the provisions of § 3 paragraph 1 letter h) of the Act on Consumer Protection in Distance Selling) and at the same time the circumstances required by law are met, the buyer has the right under the Act on Consumer Protection in Distance Selling to withdraw from the purchase agreement without giving any reason and without any sanctions.
3. The deadline for withdrawal from the contract is 30 days:
• from the moment of taking over the last delivered goods, if the subject of the purchase and sale contract is ordered goods delivered separately,
• from the moment of taking over the last part or the last item, if the subject of the purchase and sale contract is several types of goods or the delivery of several parts,
• from the moment of taking over the first delivered goods, if the subject of the purchase and sale contract is goods delivered within a specified time.
4. The Buyer acknowledges and agrees that in accordance with the provisions of § 7 sec. 6 of the Consumer Protection Act in distance selling, the consumer cannot, among other things, withdraw from the purchase contract:
• in the case of the provision of a service, if the provision of the service began with the express consent of the consumer and the consumer declared that he was duly informed that by giving this consent he loses the right to withdraw from the contract after the full provision of the service, if the full provision of the service took place,
• goods made at the consumer's special request, goods made to order or goods intended specifically for one consumer,
• goods subject to rapid deterioration or deterioration,
• goods sealed in protective packaging that cannot be returned for health or hygiene reasons and whose protective packaging was torn off after delivery,
alcoholic beverages, the price of which was agreed at the time of conclusion of the contract and the delivery of which can take place at the earliest after 30 days and the price depends on price changes on the market over which the seller has no influence,
• sound recordings, video recordings, audiovisual materials, books or computer software sold in protective packaging, if the consumer has unpacked this packaging.
5. In order to meet the withdrawal deadline, the buyer must send an unequivocal declaration expressing his or her will to withdraw from the purchase contract within the period specified in paragraph 3 of this article.
6. To withdraw from the purchase agreement, the buyer may use the sample withdrawal form provided by the seller. The withdrawal from the purchase agreement must be sent by the buyer to the seller's email address or address specified in these terms and conditions. The seller must immediately confirm receipt of the form to the buyer.
7. A buyer who withdraws from a purchase agreement is obligated to return the goods to the seller within 14 days of withdrawing from the purchase agreement. The buyer bears the cost of returning the goods to the seller, even if the goods cannot be returned by post due to their nature.
8. If the buyer withdraws from the purchase contract, the seller will immediately, but no later than 14 days after withdrawal, return all monies received from the buyer, including shipping costs. The refund will be made in the same manner in which the money was received, unless the buyer and seller agree otherwise. The seller will only return the received funds to the buyer in a different manner if the buyer agrees and if the seller incurs no additional costs.
9. If the buyer has chosen a method of delivery other than the cheapest method offered by the seller, the seller shall refund the buyer the costs of delivery of the goods in the amount corresponding to the cheapest method of delivery of the goods.
10. If the buyer withdraws from the purchase contract, the seller is not obliged to return the received funds to the buyer before the buyer hands over the goods or proves that he has sent them to the seller.
11. If possible, the buyer should return the goods to the seller with as little damage, wear, or soiling as possible, and, if possible, in their original packaging. The consumer is responsible for any diminished value of the goods if they handled the goods differently than was necessary given the characteristics and properties of the goods, and the diminished value of the product resulted from such handling.
12. The Seller is entitled to withdraw from the Purchase Agreement due to stock shortages, unavailability of the Goods, or if the manufacturer, importer, or supplier of the Goods has interrupted production or delivery of the Goods. The Seller will immediately inform the Buyer via the email address provided in the order and will refund all funds received from the Buyer under the Purchase Agreement, including delivery costs, within 14 days of notification of withdrawal, in the same manner or in the manner specified by the Buyer.
